The suit seeking to commit the National Chairman of the All Progressives Congress, Adams Oshiomhole, to prison filed by the executive of the Imo State chapter of the APC will come up for hearing on February 18.
Oshiomhole, had without respect to an existing court order, announced the dissolution of the executive of Imo State chapter of the APC and announced a caretaker committee as a replacement.
In the suit pending before a High Court of the Federal Capital Territory, sitting in Bwari, with Suit No: FCT/HC/BW/CV/103/2018, the claimant, Daniel Nwafor, sought an order of court to commit Oshiomhole to prison for allegedly disobeying the court.
The suit stated that it was unlawful for Oshiomhole to have tampered with the tenure of the elected APC state executive in Imo State, which was inaugurated on August 14, 2018.
The motion on notice sighted by our correspondent read in part, “Take notice that this Honourable Court shall be moved on the 18th Ďay of February 2019, at the hour of 9 O’clock or so thereafter as counsel on behalf of the 3rd Defendant/Applicant may be heard praying the court for the following:
“An order committing Adam Oshiomhole, the National Chairman of the All Progressives Congress, the 2nd Defendant, to prison for disobeying the order of this Honourable Court made on the 14th Day of August 2018. And for such order(s) that the Honourable Court may deem fit to make in the circumstances.”
The grounds for application as contained in the notice motion, read that, “the contemnor/party sought to be committed, disobeyed the order of this Honourable Court made on the 14th Day of August, 2018.
“Despite the service of the Mandatory Forms to the 2nd defendant/party sought to be committed, he has continued in defiance of the order of this Honourable Court.”
“It will be in the interest of justice to grant this application so as to preserve the sanctity of the Honourable Court .”
